You indicated either Question:

  1. Self-Insured Policy, but not a State of South Carolina Employee?
  2.   OR
  3. Is it a Policy with less than 50 participants in the group plan?

South Carolina’s Ryan’s Law

Individual policies, out-of-state policy providers and group plans of less than 50 participants are not required to cover ASDs by this law. We suggest you ask your insurance company to provide intensive therapy treatment options anyway.

Some Self-Insured plans are managed by an insurance company in South Carolina but are not governed by the same insurance company. You will need to ask your employer/benefits advisor to determine if you are provided with coverage (based on this law).

There is legislation pending in the SC General Assembly to address the issue of policies written by companies outside of SC. See S 0949 for details.

SCAS recommends that you speak with your providers and/or benefits coordinators at your place of employment to request that they provide intensive therapy treatment options for Autism Spectrum Disorders. While they cannot be forced to cover these treatment options, asking for the coverage may sometimes offer options in the future that are not available today.

In response to the many inquiries we have received regarding Ryan’s Law, SCAS President and CEO Craig Stoxen developed one-page flowchart reference to help explain who may benefit from "Ryan's Law" and insurance coverage for intensive therapies for ASDs.
